Terms of Service for LawStreet Journal

These terms of service (hereinafter referred to as “ToS”or “Agreement”) form a legally binding agreement between you and lawstreet.co and applies to your access and use of thelawstreet.co website (hereinafter referred to as the “Site”), which may be accessed through the World Wide Web on your browser. These terms apply whenever you access our website on any of your devices. This Agreement is for an indefinite term and you understand and agree that you are bound by such terms till the time you access this Site.

Binding Agreement

By using our website, you acknowledge that you have read, understood, and agreed to be bound by the terms of service of this Agreement, our Privacy Policy, and any other documents incorporated by reference. This Agreement constitutes “a written agreement” deemed to be signed by you as per the laws of India.

Lawstreet.co reserves any rights not expressly granted herein. The terms of this Agreement shall take effect immediately on your first use of the Site. If you do not agree to be legally bound by any or all of the following terms, please stop accessing or using the Site. By using the Site as a reader or a registered user, you are deemed to have accepted these terms of service.

General

This Agreement may be modified by lawstreet.co, for any reason, without prior notice (unless prior notice is required by law), by posting the revised Agreement on the lawstreet.co website. If at any time you do not agree to these terms and conditions, you must immediately cease your use of the lawstreet.co website.

Definitions

The following terms shall have the indicated meanings:

  1. “LawStreet Journal” is a product of EasyAdvocacyTecnologies Private Limited and an accredited journal by the Registrar of Newspapers for India (RNI) which provides detailed information on every significant incident happening in the world.
  2. The “Lawstreet.co website” and the “LawStreet Journal/magazine” (hardcopy version)are both products of the LawStreet Journal.
  3. “Lawstreet.co” or “Us” or “We” or “Our” refers to the LawStreet Journal that provides, maintains and operates the Lawstreet.co system for Lawstreet.co Users.
  4. The “Lawstreet.co System” means the software owned by LawStreet Journal; provided to Lawstreet.co Users by the Lawstreet.co website; or used by Lawstreet.co in the provision of its services.
  5. “Lawstreet.co User”, “User”, “You”, or “Your” means a natural person, corporation, or other entity that has established a User Account on the Lawstreet.co System.
  6. “Lawstreet.co Partners” or “Partners” means natural persons or entities that Lawstreet.co does business with, in order to bring the Lawstreet.co System to the marketplace.
  7. “User Account” is the online account of the User registered with the Lawstreet.co website.
  8. “Lawstreet.co Payment Processors” or “Payment Processors” means entities, service providers and systems integrated with the Lawstreet.co System to provide Users the ability to purchase our magazines through Online Payment Methods.
  9. “Lawstreet.co Payment Methods” or “Payment Methods” means the methods made available for the User to pay online for products and services, such as payment through credit cards, debit cards, bank accounts or online wallets.

Registration

When you register, you are registering as a personal user of the Site. Access to registration areas is via your email address and password. You are allowed access to the registration areas of the site on the basis that:

  • Your email address and password are personal to you and may not be used by anyone else to access the Site;
  • You will not do anything which would assist anyone who is not a registered user to gain access to any registration area of the Site; and
  • You will comply with the ToS contained herein.

If, for any reason, we believe that you have not complied with these requirements, we may, at our discretion, cancel your access to the registration areas of the Site, without giving you any advance notice.

Access and Use

Access to and use of the Site is provided by lawstreet.co subject to the following terms:

  • Lawstreet.co may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made. Your continued use of the Site after changes to this policy are posted means you agree to be legally bound by these terms as updated and/or amended.
  • You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use content on the Site in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any content on the Site except for your own personal, non-commercial use. Any other use of the Site content requires the prior written permission of Lawstreet.co.
  • You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site. Unless otherwise stated, copyright and all intellectual property rights in all material presented on the site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on the Site are the property of Lawstreet.co, its parent, affiliates and associates and are protected under applicable Indian laws. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.

Users’ Liability

You agree to not use the services provided by us to:

  • Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
  • Harm minors in any way.
  • Impersonate any person or entity, including, but not limited to, a Lawstreet.co official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the service.
  • Upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements).
  • Upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  • Upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation.

Disclaimer of Liability

Lawstreet.co does not accept any responsibility for any statement in the material published on the Website except for those published by staff reporters and company editors. Nevertheless, you must not rely on any statement we have published on the Site without taking professional legal advice. Nothing in the material is provided for any specific purpose or at the request of any particular person.

We give no warranties of any kind for material-information, names, images, pictures, logos and icons published on the Site.

You can access other sites via links from the Site. These sites are not under our control and we are not responsible in any way for any of their contents.

Lawstreet.co is not liable for any of the following losses or damages (whether such losses were foreseen, foreseeable, known or otherwise):

  • loss of data;
  • loss of revenue or anticipated profits;
  • loss of business;
  • loss of opportunity;
  • loss of goodwill or injury to reputation;
  • losses suffered by third parties; or
  • any indirect, consequential, special or exemplary damages arising from the use of Lawstreet.co regardless of the form of action.

You must take your own precaution in this respect, as we accept no responsibility for any infection by virus, by other contamination or by anything that has destructive properties.

Minors

Charges

Lawstreet.co reserves its right to charge subscription and/ or membership fees in respect of any part, aspect of this Site upon reasonable prior notice.

Submission of Graphic Material

When you send a photograph or other graphical material to us you do so in accordance with these Terms. This means that you hereby agree that you have taken the photograph(s) you have sent to us or you have permission from or are authorized by the owner of the photograph(s) to send it (them) to us, and you are granting us a non-exclusive, royalty-free license to publish or otherwise use the photograph(s) in any way and at any time we want on the Site.

The photograph(s) must not be defamatory and shall not break any laws.

Selected photographs and graphical material will be published at the discretion of the editor and you will not be paid, even if your photograph(s) is (are) published.

We may cut, edit, crop or arrange your photograph(s) or graphic as we think fit to appear on the Site, and we may remove your photograph(s) or graphics at any time.

Your name will be published alongside your photograph(s) or graphic, but we may edit or delete any comments, which you submit along with your photograph(s) or graphic.

Governing Law and Jurisdiction

These terms shall be governed by and interpreted in accordance with the laws of India, especially the Information Technology Act, 2000. All relevant rules, regulations, directions, orders and notifications will also apply. The Courts in Delhi shall have exclusive jurisdiction to the exclusion of other courts.

Force Majeure

You understand and agree that Lawstreet.co will not be held responsible for losses or damages resulting from suspension of service due to extraordinary events or circumstances beyond the control of Lawstreet.co (a “Force Majeure Event”). In the event of a Force Majeure Event, Lawstreet.co may suspend service and access to the Lawstreet.co System

Termination

Lawstreet.co, in its sole discretion, reserves the right to terminate this Agreement, access to our website, or access to the Lawstreet.co System for any reason and at any time upon notice to you.
