Cordelia cruise drugs case: Delhi Court issues notice to Police on Sameer Wankhede's plea against Gyaneswar Singh Read Order

NEW DELHI: On Wednesday, a Delhi Court sought responses from the Delhi Police on the complaint filed by IRS Officer Sameer Wankhede against IPS Officer and NCB DDG Gyaneshwar Singh. 

Additional Sessions Judge Devender Kumar Jangala of Patiala House Courts issued notice to the Deputy Commissioner of Police (South West District, Delhi) and directed for filing an action report with regard to Wankhede’s complaint.

“In view of submissions and material on record, issue notice to Deputy Commissioner of Police, South West District, Delhi to file the action taken report in respect of complaint dated 18.07.2023, made to Mumbai Police, Maharashtra, received in his office vide letter dated 06.12.2023 and referred in the emails dated 22.12.2023 and 26.12.2023 of the complainant, for the next date.”

Wankhede (the complainant) sought to registration of First Information Report against Singh under provisions of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989. It is his case that Singh harassed him during the enquiry in relation to the alleged procedural lapses pertaining to the Cordelia cruise drugs case.

The complainant told the court that he had lodged a complaint for commission of offences under the POA Act with Mumbai Police, Maharashtra on July 18, 2023. Later, the police authorities, via a letter dated December 6, 2023 informed him that his complaint had been transferred to Deputy Commissioner of Police, South West District for further necessary action.
On two subsequent occasions, the complainant sent emails to Deputy Commissioner of Police, South West District, Delhi seeking the status but to no avail. 

“That despite repeated requests, DCP, Delhi Police, South West District, Delhi has fails to register the FIR or to take necessary action, hence the complainant was compelled to approach this court”, the court recorded in the order. Owing to this, the court has sought a status report from the authorities now. 
The matter will be next taken up on February 27. 

Last year, in August, the Central Administrative Tribunal had observed that Gyaneshwar Singh, being actively involved in the investigation could not have been part of the SET, and directed that an opportunity for a hearing be given to Wankhede before taking any action. 

Advocates Anand Kumar, Aditya Giri, Sadaf Imran and Hemant Kalra appeared for Wankhede.
